BMW & Henrob - Intellectual Property Dispute

BMW Group and Henrob have reached a settlement enabling BMW Group to continue using certain self-pierce riveting equipment supplied to them by Böllhoff Systemtechnik. Henrob alleges that using this equipment in the United States, and the sale in and/or importation into the United States of BMW’s products manufactured using this riveting equipment, infringe its US Patent No. 5,752,305.
Under the terms of the confidential settlement, Henrob has undertaken not to seek injunctive relief to prevent the importation of certain BMW Group vehicles into the United States and other countries in exchange for a payment from BMW Group. Henrob will continue to pursue its actions filed against BMW Group and Böllhoff Systemtechnik in the United States District Court for the Eastern District of Michigan seeking to establish liability and, with respect to BMW Group, past damages for the alleged improper use of its patent prior to signing the settlement agreement. BMW denies any wrongdoing or liability and intends to join Böllhoff in defending Henrob’s claims of infringement in the pending district court litigation.
Henrob’s CEO and Chairman, Keith Jones commented:
“We regret having to involve BMW in this legal dispute and would have preferred to resolve the matter amicably with Böllhoff but unfortunately we were unable to do so. It is our policy to vigorously defend our intellectual property.”
11th May 2010: Henrob, Böllhoff, BMW and Rolls-Royce Resolve Patent Dispute Involving Preclamping Self-Pierce Riveting Technology
Henrob, Böllhoff, BMW, and Rolls-Royce have reached an agreement to settle their patent infringement lawsuit pending in the U.S. District Court for the Eastern District of Michigan. Under the terms of the confidential settlement, Henrob has granted Böllhoff limited rights to continue manufacturing, selling and offering to sell preclamping self-pierce riveting systems, except in the United States.
Also, under the terms of the confidential settlement, Henrob has agreed to allow Böllhoff's customers to continue to use existing preclamping self-pierce riveting systems and to manufacture products with existing preclamping riveting systems that can be sold or imported anywhere in the world, including the United States.
Also, as part of the confidential settlement, Henrob has agreed that Böllhoff's Final Compression Riveting Technology, as described in the abstract of U.S. Patent No. 7,370,399, does not infringe any patents currently owned by Henrob, and Böllhoff and BMW have agreed that Henrob's U.S. Patent Nos. 5,752,305 and 5,779,127, covering Preclamping Riveting and Vacuum Punch Technologies, are valid patents.
